CONNECTION FEAST, LLC COACHING INDEMNITY/RELEASE/WAIVER
I understand that none of Connection Feast, LLC nor Alexandra Friedman nor any member of the support team and/or guest speakers or connection coaches neither collectively nor individually claim to be licensed medical or mental health professionals of any kind. If I am currently under the care of a mental health professional, it is my responsibility to consult with that professional/person regarding the advisability of working with life coaches and/participate in the program(s) offered. While I may be introduced to some concepts that are used in similar fields (e.g., psychotherapy) I understand this is a coaching program and none of the principals or support team or guest speakers are trained therapists.
While a participant of a Connection Feast, LLC program, I will never claim coaching as a substitute for counseling, psychotherapy, mental health care, or substance abuse treatment.
Connection Feast, LCC has the right to refuse service to anyone including without limitation currently enrolled students at our discretion. You agree that your investment with Connection Feast LLC is non-refundable unless it falls within the refund window. Any refund or partial refund is at the sole discretion of Connection Feast, LLC. I understand that I am expected to uphold the Community Guidelines and that I could be asked to terminate participation within the program, if I do not uphold those standards.
I understand that Connection Feast, LLC is a personal development course. I understand that challenges may come up in the program including but not limited to my own development, personality dynamics with other students or coaches or guest speakers, and personal growth-related issues. I agree to be coachable and receptive to feedback from fellow attendees, support staff, coaches, and guest speakers. Signing up for this course means that I will accept responsibility for the personal coursework involved and, if necessary, will reach out for additional support (counseling and/or coaching) outside the program.
I am responsible for seeking independent personal and professional guidance in specialized areas. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my responsibility. I understand that anything outside of the scope of Connection Feast, LLC must be referred or reported. Reportable incidents included but are not limited to suicidal ideation, behavior that may put or does put others or self in harm’s way and/or potential mental illness. If you are unsure you are required to consult with a member of the Connection Feast, LLC team.
I agree to indemnify Connection Feast, LLC, or Alexandra Friedman nor any member of the support team and/or guest speakers or connection coaches neither collectively nor individually from any third party claims based on my breach of the above promises.
By proceeding through this coaching program, I am freely and voluntarily assuming the risks arising from my participation. I take full responsibility for my personal health, mental and emotional health and well-being, my actions and decisions, and my personal care during my time in this program and thereafter.
I understand that I will be encouraged to participate in groups of 2-3 other participants where I listen and share with others and others listen and share with me for for a minimum of one hour per week. I am committed to this work and will show up with vulnerability and compassion. I will treat myself and my fellow students with respect. I understand the importance of creating a safe space for myself and others.
I will not slander or demean Connection Feast, LLC or Alexandra Friedman nor any member of the support team and/or guest speakers or connection coaches either collectively nor individually or in any capacity for any reason within any of my internal communication containers within the coaching course or public facing in any way.
The information and processes taught in this program are real and based on years of work with people. However, Connection Feast, LLC cannot guarantee any outcome of a relationship or any other desired outcome by participating in this program.
All products and services by Connection Feast, LLC are for educational and informational purposes only. You alone are responsible and accountable for your decisions, actions, and results in life, and by your registration here you agree not to attempt to hold us liable.
GROUP EVENTS: TICKETS; COMMUNITY AGREEMENT;
(a) Group Coaching Ticket Purchases
You may purchase tickets (collectively, “Event Tickets”) to any of our Feasts or other events (collectively, “Events”) via our website or select Third-Party ticketing platforms. Event Tickets must be in your own name and may not be transferred or resold. Before purchasing your Event Tickets, we urge you to confirm the date, time, and location of the Event to ensure that it does not conflict with your schedule.
(b) Coaching Refunds
Any requests for coaching refunds must be made up to 48 hours after the start of the group coaching program that you signed up for, your account will be refunded (minus the Stripe fees), and you will not be charged again. To cancel your involvement and be refunded, please contact us at: letsconnect@connectionfeast.com with your name and reason for cancelation, and we will accommodate your refund request within 2 business days. Please note that refund may take longer to transfer and show on your account. Requests will be considered on a case-by-case basis and at our sole and absolute discretion. If a refund is requested after 48 hours after the program you signed up for, no refunds will be given. By purchasing group coaching services, you agree to our refund policy. Read below for additional information on refunds.
(c) You Agree to the Terms of Our Community Agreement
Connection Feast should be a comfortable and safe experience for everyone, and as a Feaster, you have a responsibility to help us achieve this. All Feasters who attend and participate in any Feasts are required to abide by the terms of our Community Agreement. If you engage in unacceptable behavior, the host and/or facilitators of the Feast may take appropriate action, at their sole discretion.
OUR PLATFORM AND GROUP COACHING PROGRAMS
(a) We Grant You a Limited License to Use Our Platform
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, non-transferable, and revocable right to access our Platform for your personal, non-commercial use. We reserve the right to monitor our Platform for the purpose of determining that your usage compiles with these Terms. This license does not include any resale or commercial use of the Platform, any collection and commercial use of any of Our Content, any non-personal use of Our Content, any derivative use of the Platform, any downloading, copying or other use of the Platform or Our Content for the benefit of any Third-Party, or any use of data mining, robots or similar data gathering and extraction tools. You may use our Platform only as permitted by law.
(b) Prohibited Uses of Our Platform
You may not use our Platform other than as expressly permitted by these Terms. In your use of our Platform, you may not, directly or indirectly: (a) copy, reproduce, modify, distribute, display, create derivative works of, republish, post, transmit, or participate in the transfer or sale of any of Our Content or any Member Content; (b) use our Platform in a commercial manner, including, but not limited to, advertising your products and/or services, or contacting other Members for an unsolicited commercial purpose; (c) impersonate another person or entity, misrepresent your affiliation with any person or entity, or use a false identity; (d) attempt to obtain unauthorized access to our Platform; (e) collect information about our Members or other users of our Platform; (f) access our Platform in order to build a competitive product or service; (g) reverse engineer, decompile, tamper with or disassemble any technology used to provide our Platform; (h) interfere with or damage our Platform or underlying technology, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial of service attacks, packet or IP spoofing, forged routing or electronic mail address information, or similar methods or technology; (i) disrupt or interfere with the security of our Platform or any websites linked to our Platform; (j) interfere with any Member’s or Third Party’s ability to use, access, or enjoy, or our ability to provide, our Platform; (k) violate, misappropriate or infringe any Third Party’s intellectual property or other right; or (l) violate any law, rule or regulation.
(c) Suspension of Our Services
Notwithstanding anything to the contrary in these Terms, we may temporarily suspend, or permanently revoke, your access to the Platform if we reasonably determine in our sole discretion that you have violated any of the terms of this Section. In the case of a temporary suspension, we shall use commercially reasonable efforts to provide you with written notice of the suspension, updates regarding any investigation, and your ability to dispute the suspension, if applicable. We shall use commercially reasonable efforts to resume providing access to the Platform as soon as reasonably possible after the event giving rise to the temporary suspension is cured. We shall have no liability for any damages, liabilities, losses (including any loss of data or profits), or any other consequences that you may incur as a result of any temporary suspension or permanent revocation of your access to the Platform.
(d) Group Coaching Registration
You must pay for the program and fill out and complete a form to join the group coaching program. In doing so, you must provide us with current, accurate, and complete information. You must keep your information up to date and promptly notify us of any changes to your information. It is particularly important to keep the email address associated with your involvement current because you will not be able to receive messages from us about your account or involvement.
(e) We are Not Obligated to Retain Your Information
Connection Feast is not under any obligation to retain a record of your account, your use of the Platform, or any data or information that you store in your account for your convenience.
(f) Sharing Your Personal Information
You may share select personal information via our Platform which is made available to other group members on our platform or through shared forms. PLEASE DO NOT SUBMIT ANY PERSONAL INFORMATION OR OTHER INFORMATION THAT MAY COMPROMISE YOUR PERSONAL SAFETY OR SECURITY. Your submission of any personal information via our Platform or Our Social Media is governed by our Privacy Policy. Please click here to view the most recent version of our Privacy Policy.
(g) Group Coaching Payment Services
To sign up for a group coaching program, you agree to provide current, complete, and accurate payment information and agree to promptly update your account and other information including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
(h) Payment Plans & Conditions
I acknowledge that if I am on a payment plan and I miss a month, I will be granted a 15 day grace extension period with a one-time and final warning, where in this time I can continue to participate in Connection Feast, LLC. If that missed payment is not made within 15 days, along with any next applicable payments, then I recognize I will be restricted access from all aspects of the program irrespective of where I am in my payment plans and in the program. After access is restricted, I acknowledge that I will have 15 more days to arise with any and all missed payments and if this is successful, I will be allowed full participation into the program.
(i) Automatic Billing Cycles
Our Payment plans are offered in billing cycles of either: (i) in full (ii) 90 days (three cycles/three months). If a payment plan is chosen, this means that your credit card on file via Stipe will automatically and continuously be charged on selected Billing Cycle for an additional two Billing Cycles until it is paid off. Picking a payment plan also includes additional finance charges. PAYMENT PLANS AUTOMATICALLY CHARGE. YOU ACKNOWLEDGE AND AGREE THAT YOUR CREDIT WILL AUTOMATICALLY BE CHARGED BASED ON YOUR CHOSEN BILLING CYCLE UNLESS CONNECTION FEAST TERMINATES YOUR INVOLVEMENT IN ACCORDANCE WITH THESE TERMS.
Please note that you may not receive an email notification before your upcoming payment. You can always view your next billing cycle on your original receipt or reach out to connection feast at letsconnect@connectionfeast.com for a copy of the receipt.
(j) Refund Requests Must be Made 48 Hours After the Start of the Group Coaching Program
If you request a refund up to 48 hours after the start of the group coaching program that you signed up for, your account will be refunded (minus the Stripe fees), and you will not be charged again. If a refund is requested after 48 hours after the program you signed up for, no refunds will be given. To cancel your involvement and be refunded, please contact us at: letsconnect@connectionfeast.com with your name, the program you’re in, and reason for cancelation, and we will accommodate your refund request within 2 business days. Please note that refund may take longer to transfer and show on your account.
BREATHWORK, MEDITATION, VISIONING, OR SOMATIC WORK
If it so happens that Breathwork, Meditation, visioning, or Somatic Work of any kind is part of the service, I acknowledge that I have voluntarily enrolled in this type of activity.
I understand that I am under no obligation of any kind to participate in this type activity, and I voluntarily enter into this Waiver and Release of Liability.
I understand that Breathwork, Meditation, visioning, or Somatic Work of any kind is a personal growth experience designed to enhance the quality of life and is not a substitute for psychotherapy.
I understand that this Breathwork/Somatic Work activity will involve strong connected breathing and may include guided meditation.
I understand that Breathwork/Somatic Work can involve dramatic experiences accompanied by strong emotional and physical responses.
I understand that I may find Breathwork/Somatic Work physically, emotionally, and/or mentally stressful. I hereby affirm that I am in good health and able to participate in this activity. I do not have any physical or mental conditions which would impair my ability to engage in this activity or which would otherwise endanger my health during this Breathwork/Somatic Work activity, or which would cause any risk of harm to myself or other participants.
I understand that this Breathwork/Somatic Work activity is not medically supervised. I have hereby been advised that I should talk to my physician and/or psychotherapist if I have any questions about my physical or mental ability to safely participate in this Breathwork/Somatic Work activity. If I have chosen not to obtain a physician’s consent prior to my participation in Breathwork/Somatic Work, I hereby agree that I am doing so solely at my own risk.
I understand that it is my sole responsibility to participate in activities that are appropriate for the current status of my health and to modify this Breathwork/Somatic Work activity to accommodate my own needs or limitations. If I have any questions or concerns about whether or not a particular activity is appropriate to my current health status, I understand it is my responsibility to ask my doctor before I participate in such an activity. I agree to indemnify and hold harmless Connection Feast, LLC from and against any and all claims and expenses, including attorney’s fees, arising out of my participation in this Breathwork, Meditation, or visioning, or Somatic Work of any kind.
In consideration of my participation in this Breathwork, Meditation, or visioning, or Somatic Work of any kind, I hereby waive and release Connection Feast, LLC or Alexandra Friedman nor any member of the support team and/or guest speakers or connection coaches from any and all claims, costs, liability and expense for any injury, loss or damage whether known, anticipated or unanticipated arising from my participation in Breathwork/Somatic Work.
I understand there are certification programs for Breathwork/Somatic work that are required before I can use it in my coaching practice but in all instances, I understand that if I intend to use Breathwork/Somatic work in my coaching practice I will pass on each and every of the above considerations to my clients.
I agree to indemnify Connection Feast, LLC or Alexandra Friedman nor any member of the support team and/or guest speakers or connection coaches from my use of Breathwork, Meditation, or visioning, or Somatic Work of any kind in my personal practice or otherwise.
This Indemnity obligation and Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge that I have thoroughly read this Waiver and Release of Liability in its entirety and fully understand it. By agreeing to these terms, I am waiving certain rights I and/or my successors might have to bring legal action or assert a claim against Connection Feast, LLC.
VIDEO, AUDIO, & PHOTOGRAPHY RELEASE
I hereby consent to be photographed, recorded, and/or filmed by Connection Feast, LLC on the following terms:
Connection Feast, LLC will own any and all rights in the photography, recording, or filming for the purposes of the Connection Feast, LLC training and marketing (the “Use”). Recordings of live coaching sessions will only be seen internally or by other Connection Feast, LLC coaching students who have enrolled in the course and will not be utilized for social media, marketing, or any other public purposes. I acknowledge and agree that these limitations do not apply to a testimonial I provide.
I consent to the Use of any printed material in conjunction with the abovementioned Use.
I hereby waive all personal rights and objections to, including the right to inspect, any Use which will be made of my Appearance by Connection Feast, LLC. “Appearance” as used herein means my name, image, physical likeness, voice, any and all attributes of my personality and/or performance;
I hereby waive, release and forever discharge the Connection Feast, LLC and all persons acting under its permission or authority from all claims, actions, and liability relating to Use.
I understand that I will not receive any payment or any form of remuneration now or in the future in consideration for the above consent.
